Yes - the Party Wall etc. Act 1996 applies regardless of whether a property is in a conservation area or is a listed building. Conservation area and listed building consents are separate planning requirements. Party wall obligations apply wherever the works affect a shared wall, boundary structure, or involve excavation near an adjoining owner's foundations.
A Party Wall Notice is the formal document served on adjoining owners before works begin - it informs them of the proposed works and their rights under the Act. A Party Wall Award is the legally binding agreement prepared by the appointed surveyor(s) when a neighbour dissents, setting out exactly what work can be carried out, how, and when.
Yes. Where both the building owner and the adjoining owner are happy to appoint a single surveyor, Aspen Party Wall Surveyors can act as the Agreed Surveyor.
